Daisy Digital Marketing Terms & Conditions of Service
Upon working with us, you are agreeing to the below terms and conditions. Please make sure you have read and understood these. Note these terms are supportive of contracted terms.
Update September 13th 2024Â
All ad content created during the time with Daisy Digital will be deleted from ad accounts at the end of our agreement. If you wish to use content created during our agreement a licence fee will apply. If you are found to be using any creatives or slight variants of those developed during our agreement you will be sent an invoice to this effect.Â
Update March 14th 2024
Any IP and knowledge obtained and shared during any training or coaching is not to be used for resale in any courses or client support. It is only for use on the attendee’s own business in which they are part of, not any of their clients.

Pricing changes will occur from time to time. Any pricing changes you will be notified of at least 30 days in advance.

This document will refer to “us” being Daisy Digital Marketing and “you” or “the client” being you, the client entering the agreement.
General Terms & Conditions
– Our scope of advice is limited to the marketing field. We may be able to provide you with supporting documents (such as T&C’s), but you are responsible for these fully and we recommend you consult a lawyer or relevant professional.
– Our rates are subject to change. Any changes will always be communicated to you and approved before work commences.
– Timeframes on the contracts act as a guideline for work. Work can only be completed once we have everything we need from the client as agreed.
– Where ever a 3-month trial period or an initial contract period is defined, this refers to a minimum term (e.g a 3-month trial is a 3-month minimum term). If stated in the contract, you are required to adhere to a 3 month minimum term and a notice period always applies. Unless mutually agreed in writing before a contract is in place. There is a 60 day notice period required for cancellation of services. This includes cancelling within the initial 3 month term. For example, if you wish to end at the end of a month trial, you must provide 60 days notice in writing before the end of the month. This includes cancelling within the initial 3-month period (aka if you want to finish at 3 months you need to provide 60-days notice, which would be after 1-month).
– If no cancellation notice period is specified for a service, then 60-days notice of cancellation applies.
– Any ad-hoc work or training/coaching is charged for all hours spent, not just contact hours (unless specified otherwise) for example, follow-up questions are chargeable.
– A miniumn charge of 30 minutes applies

Logo and Graphic Design
– Final logo design and files belong to you, the client (once full and final payment is made). All other concepts remain the property of Daisy Digital Marketing.
– Additional changes outside of the contracted scope are fully chargeable at standard hourly rates.
Website Design
– Once a website is completed and live, the ownership lies with you, the client.
– Once a website is live, our contract is completed and all obligations are met from Daisy Digital Marketing, unless we have mutually agreed otherwise in writing (for example any outstanding elements).
– Once a site has gone live, we are not responsible for any issues you might have at any stage in the future. Unless you are hosting or have a retainer with us that includes this support (and further work is explicitly detailed in your contract). Any further work will be fully chargeable at our standard hourly rates.
– Anything outside of the agreed scope is fully chargeable at our standard hourly rate.
–Â It also does not include any licensing for plugins or themes unless otherwise agreed.
– The client needs to supply logos and branding guidelines unless otherwise discussed.
– Content (imagery and copy) is to be supplied by the client, unless otherwise agreed prior.
– A miniumn charge of 30 minutes applies
Website Hosting
– Our standard website hosting includes an SSL (security certificate), premium hosting, maintenance of plugins, themes and WordPress core (monthly and unless otherwise specified in your contract). Unless your contract states otherwise, we also hold daily back-ups for 7 days and a monthly local back up (an hourly rate applies if you require us to access these).
– It also does not include malware removal or hacking support. This is offered additionally at a monthly fee, or if you have website issues an hourly rate. It does also not include any licensing for plugins or support for out of date plugins.
– A minimum of 60-day notice of cancellation in writing is required.
– Hosting does not include any monthly support in terms of website updates or advice – this is additional and charged at our standard hourly rates.
Google Ads
– Please see your contract for minimum timeframes. The general terms and conditions listed above apply here.
– Creation of display advert creative is not included unless specified.
– If you require a plan change, we will communicate this with you.
– Ad spend is additional and paid directly to Google (unless otherwise arranged).
– You agree to not make any changes to your account during our management, any changes you make can impact account performance and we can’t manage the account effectively.
– As part of Daisy Digital Marketing’s offboarding process, once this contract concludes, we will be required to deactivate all advertising content created by the Daisy Digital Marketing team. You will still have access to all data and insights from the engagement period during which Daisy Digital Marketing ran your google advertising. Failure to allow us to complete our offboarding process will incur a fee of $2400+gst for use of content.
– Any ad copy developed by Daisy Digital Marketing for your business is licensed only for use during the period of your engagement and intended for the purpose it was developed for only.

Social Media Ads
-Social media advertising is limited depending on the management fee plan you are on as to how many ads we manage on your behalf. We recommend you do not make any changes to your ad account during our period of management (as per your contract). Creative development and copy development is also limited to 1 hour per month unless otherwise specified and the remainder of the time is used for optimisations and reporting.Â
Daisy Digital adhere to the following assumption (unless otherwise specified);
- Management of 1x ad account and 1x Facebook account, and 1x Instagram account (Additional accounts will need to be discussed with your account manager prior to engagement)
- Campaign sales funnel with no more than 3 campaigns and 2 ad sets per campaign unless otherwise specified
- Ads reviewed and optimised by DDM twice monthly
- Simple monthly report Â
- Audiences will be developed DDM (please send through your customer profile or avatar, if you don’t have this please create one thinking about the common characteristics of your ideal customers)Â Â
- Pixel already loaded / tested (additional fee of $150 if we need to fix this or set up)Â Â Â Â
- Google analytics already setup
- Copywriting included
- Images or video to be supplied by the client (or account content can be used – e.g exisiting page images)
- Client can see the first round of ads before we run them and make one round of amends (if they like)
- Simple reporting included (statistics such as new page likes, conversions, landing page views related to campaign goals). More detailed reporting is an add-on.
- Meetings/calls are additional unless otherwise specified
The below are not included, unless otherwise detailed in your contract;
- Any additional changes to campaigns during the month
- Image/video sourcing outside your account (e.g. stock imagery, photography, video creation)Â
- Pre-approval of posts
Please refer to your specific contract terms. Additional fees will apply for this work (billed at a standard hourly rate).

Training
– All training and consultancy recorded videos must be used only for the participating recipient they were intended for. These must NOT be used or passed on for other training purposes to anyone other than those they were intended for.
Additional Hours
– We are happy to help you with ad-hoc support as needed at our standard hourly rates.
– Upon signing your contract you, the client, understand that any work completed outside your scope is fully chargeable at our standard hourly rates, please enquire for details, by agreeing to commence work, you agree to our current rates (which are subject to change).
Payment Terms
– Payment is due on the 20th of the month, unless otherwise specified in your contract. All overdue accounts will incur interest as stated on your account (generally 3%) and should collection be required for payment, all collection fees will be applicable and paid in full by the client.
